Ellara Jewelry Terms & Conditions

Last Updated: September 10, 2026

Welcome to Ellara Jewelry.

These Terms & Conditions (“Terms”) govern your use of the Ellara Jewelry website, your purchase of products from us, your participation in our DesignMe and other customization services, and your purchase or use of in-studio jewelry services.

Throughout these Terms, “Ellara,” “Ellara Jewelry,” “we,” “us,” and “our” refer to Ellara Design Incorporation, operating as Ellara Jewelry. “You” and “your” refer to the customer, website visitor, purchaser, appointment holder, or recipient of our services.

By accessing our website, placing an order, purchasing a product, submitting a custom order, booking an appointment, purchasing a gift card, or otherwise using our services, you agree to these Terms and any policies incorporated into them, including our Return & Refund Policy, Shipping Policy, Privacy Policy, Warranty Policy, and any product- or service-specific terms displayed before purchase.

If you do not agree with these Terms, please do not use our website or purchase our products or services.

1. About Ellara Jewelry

Ellara Jewelry is operated by:

Telephone: 780-289-0925

Ellara is an independent jewelry studio based in Edmonton, Alberta, Canada.

We specialize in meaningful, personalized jewelry, including custom-fitted jewelry, permanent jewelry, made-to-order pieces, engraved jewelry, and our DesignMe collection.

Many Ellara pieces are individually assembled, fitted, engraved, finished, customized, or handmade to order. As a result, small variations may naturally occur between individual pieces.

Our website is operated through Shopify and may use additional third-party applications and service providers.

2. Retail Customers

These Terms are intended for retail consumer purchases.

Wholesale, reseller, corporate, bulk, and business-to-business transactions may be subject to separate B2B or Wholesale Terms.

Purchasing through the retail website does not automatically grant wholesale or resale rights.

3. Agreement to Our Policies

These Terms should be read together with all applicable Ellara policies, including:

  • Return & Refund Policy

  • Shipping Policy

  • Privacy Policy

  • Warranty Policy

  • Permanent Jewelry policies

  • Product-specific instructions and disclosures

  • DesignMe customization information

  • Appointment and booking terms

These policies form part of your agreement with Ellara where applicable.

Nothing in these Terms is intended to waive, restrict, or exclude rights that cannot legally be waived under applicable consumer protection legislation.

CUSTOMER INFORMATION & ELIGIBILITY

4. Eligibility to Purchase

Customers placing orders must have the legal capacity to enter into a purchase contract or have appropriate authorization where required by law.

Certain in-studio services may have additional age or consent requirements.

5. Minors & Permanent Jewelry

Customers aged 18 or older may independently consent to permanent jewelry services.

Customers under 18 require the consent of a parent or legal guardian before receiving permanent jewelry or another service for which Ellara determines guardian consent is appropriate.

Ellara reserves the right to:

  • Request confirmation of age;

  • Request confirmation of parental or guardian consent;

  • Require a parent or legal guardian to be present;

  • Decline or postpone service to a minor where appropriate consent cannot be reasonably confirmed; or

  • Refuse a service where we reasonably believe proceeding would be inappropriate or unsafe.

Ellara's priority is to ensure that minors receiving services have appropriate consent and understand the nature of the service.

6. Customer Information

You agree to provide complete and accurate information when:

  • Placing an order

  • Creating an account

  • Booking an appointment

  • Providing shipping information

  • Providing billing information

  • Submitting measurements

  • Selecting customization options

  • Providing engraving instructions

  • Providing personalization information

You are responsible for reviewing this information before completing your purchase.

Ellara is not responsible for errors resulting from information entered incorrectly by the customer, including incorrect:

  • Names

  • Initials

  • Dates

  • Addresses

  • Measurements

  • Sizes

  • Lengths

  • Birthstones

  • Charms

  • Metals

  • Engraving text

  • Personalization instructions

If Ellara makes an error and the finished product does not match the information contained in the confirmed order, please contact us according to our Return & Refund Policy.

ORDERS & PAYMENT

7. Order Acceptance

Submitting an order does not necessarily mean the order has been accepted.

We reserve the right, where reasonably necessary, to refuse, limit, or cancel an order before fulfillment.

Reasons may include:

  • Inventory errors

  • Pricing errors

  • Product discontinuation

  • Technical errors

  • Suspected fraud

  • Payment authorization problems

  • Unavailable materials

  • Inability to complete a requested customization

  • Incorrect website information

  • Orders that violate these Terms

  • Orders that present a reasonable fraud or chargeback risk

If we cancel an order after payment has been successfully collected and no product or service has been provided, the applicable amount will be refunded.

8. Pricing

Unless otherwise stated, prices are displayed in Canadian dollars (CAD).

Prices may change without notice.

Applicable taxes, shipping charges, and other applicable fees will be disclosed during the purchasing process where required.

If Ellara later expands international shipping, customers outside Canada may also be responsible for customs, duties, taxes, brokerage fees, or other import-related charges unless specifically stated otherwise.

9. Pricing & Listing Errors

We make reasonable efforts to keep product descriptions, prices, inventory, photographs, specifications, promotions, and other website information accurate.

Errors may occasionally occur.

We reserve the right to correct genuine errors.

If a material pricing, inventory, or product-information error affects an order before fulfillment, we may contact you regarding the issue or cancel and refund the affected item.

10. Payment

Payment must be successfully authorized before an online order is processed unless expressly agreed otherwise.

Payment processing may be handled by Shopify, payment processors, banks, credit card networks, digital wallets, or other third-party providers.

You confirm that you are authorized to use the payment method submitted with your purchase.

MADE-TO-ORDER & CUSTOM-FITTED JEWELRY

11. Made-to-Order Jewelry

Many Ellara products are made specifically for the customer after an order is placed.

Products may be:

  • Cut to size

  • Assembled

  • Engraved

  • Personalized

  • Finished

  • Customized

  • Made according to selected specifications

Because these pieces are prepared specifically for you, they are generally final sale as described in our Return & Refund Policy.

12. Custom Sizing

Customers are responsible for providing or selecting the correct size or length.

Where applicable, customers should follow the sizing instructions displayed on our website.

For bracelets, our general sizing guidance may instruct customers to measure their wrist and add approximately 0.25 inches of ease for a comfortable fit, unless a product page states otherwise.

Personal fit preference differs between individuals.

Please measure carefully before ordering.

Custom-fitted jewelry cannot generally be returned or exchanged simply because:

  • The customer submitted the wrong measurement;

  • The customer selected the wrong size;

  • The customer later prefers a different fit; or

  • The customer's measurement technique was inaccurate.

If Ellara makes the item in a size materially different from the confirmed order specification, please contact us according to our Return & Refund Policy.

DESIGNME

13. DesignMe Custom Jewelry

DesignMe allows customers to create personalized jewelry using available components and customization choices.

Depending on the product, customers may select:

  • Jewelry type

  • Base chain

  • Size or length

  • Metal

  • Charms

  • Birthstones

  • Initials

  • Connectors

  • Arrangement

  • Finish

  • Other available options

Your submitted selections are used to create your finished piece.

Please carefully review all selections before completing your order.

DesignMe Live Preview & Design Instructions

The DesignMe live-view builder provides a visual guide for creating your jewelry. Please include any specific placement or spacing instructions in your order notes at checkout, such as “no spaces between charms” or “space charms evenly.” If there is a design detail you want to ensure we do not overlook, please send us a message.

If no instructions are provided, we will create your piece as closely as possible to your live-view design while maintaining a balanced look.

14. DesignMe Preview

DesignMe may include an online visualization or live-preview function.

The preview is designed to help you visualize your piece and is not a technically exact CAD representation or guarantee of precise physical scale.

Actual appearance may vary depending on:

  • Chain link size

  • Jewelry length

  • Number of charms

  • Charm dimensions

  • Natural jewelry movement

  • Charm placement

  • Handmade assembly

  • Component tolerances

  • Screen size and display settings

Link scale may also appear differently depending on the selected jewelry size and number of charms.

Minor differences between the digital preview and the finished piece are not considered defects.

15. DesignMe Final Sale

DesignMe products are created according to the customer's individual selections and are therefore final sale, except where otherwise required by law or where Ellara confirms that an item was incorrectly produced or arrived damaged or defective.

Customers are responsible for reviewing their DesignMe selections before submitting their order.

PERSONALIZATION & ENGRAVING

16. Personalized Jewelry

Personalized jewelry includes pieces customized according to customer-selected information or components, including:

  • Initials

  • Names

  • Dates

  • Birthstones

  • Symbols

  • Family combinations

  • Charm combinations

  • Custom arrangements

Personalized pieces are made specifically for the customer and are generally final sale.

17. Engraving

Customers are responsible for reviewing all engraving details before purchasing.

This includes:

  • Spelling

  • Capitalization

  • Names

  • Initials

  • Dates

  • Numbers

  • Symbols

  • Requested wording

Once engraving has begun, the order generally cannot be modified or cancelled.

Minor differences in engraving depth, position, alignment, spacing, or appearance resulting from the size, shape, finish, or handmade nature of the item are not necessarily defects.

If Ellara engraves something differently from the information contained in the confirmed order, please contact us according to our Return & Refund Policy.

PERMANENT JEWELRY

18. Permanent Jewelry Service

Permanent jewelry is custom-fitted directly to the wearer and connected without a traditional clasp, typically by welding the chain closed.

During an appointment, customers may browse available chains and optional charms, select their preferred piece and fit, and choose to have the jewelry welded closed.

Where available, customers may instead request that a clasp be added for a removable custom-fitted piece.

19. Permanent Jewelry Final Sale

Permanent jewelry is final sale once fitted and welded onto the wearer.

Because permanent jewelry has been custom-fitted and worn directly on the body, we cannot accept it for return for hygiene reasons.

Once permanent jewelry has been cut or intentionally removed, the original purchase remains non-refundable unless otherwise required by law.

Warranty services, repairs, or re-welding do not make an otherwise final-sale purchase refundable.

20. Permanent Does Not Mean Indestructible

“Permanent jewelry” describes jewelry designed to be continuously worn without a traditional clasp.

It does not mean the jewelry is indestructible or guaranteed to remain attached forever.

Permanent jewelry may break from:

  • Snagging

  • Pulling

  • Impact

  • Exercise

  • Clothing

  • Children or pets

  • Workplace activities

  • Lifestyle

  • Accidental damage

  • Normal wear

  • Other external forces

For safety, permanent jewelry is designed so that it may break under sufficient force.

How long a permanent piece remains attached depends significantly on the wearer and their lifestyle.

21. Permanent Jewelry Removal

Permanent jewelry may be removed by carefully cutting the appropriate connecting point or chain.

Customers may sometimes be required to remove permanent jewelry for:

  • Medical procedures

  • Imaging or surgery

  • Employment requirements

  • Sporting activities

  • Security requirements

  • Other third-party rules

Ellara is not responsible for requirements imposed by hospitals, employers, transportation authorities, sports organizations, or other third parties.

Depending on the condition of the piece, it may be possible to re-weld it or convert it to clasped jewelry.

MATERIALS, APPEARANCE & CARE

22. Materials

Ellara may offer jewelry in materials including:

  • Sterling silver

  • 14K gold filled

  • Gold vermeil

  • Solid gold

  • Other materials clearly identified on individual listings

Material descriptions are based on supplier specifications, industry standards, and our own production information.

23. Metal Sensitivities

Customers with known sensitivities, allergies, or previous reactions to jewelry should review material descriptions before purchasing.

Customers receiving an in-studio service should tell Ellara about known metal sensitivities before the jewelry is applied.

Individual skin reactions vary.

Ellara cannot guarantee that a particular metal will be suitable for every person's skin.

24. Natural Wear

Jewelry naturally experiences wear over time.

The rate and appearance of wear can depend on:

  • Frequency of wear

  • Skin chemistry

  • Friction

  • Lifestyle

  • Water exposure

  • Moisture

  • Chemicals

  • Cosmetics

  • Chlorine

  • Salt water

  • Exercise

  • Storage

  • Care

Sterling silver may naturally oxidize or tarnish.

Gold-filled and gold-vermeil jewelry contain gold over another metal and may gradually show wear over time.

Normal wear, scratches, oxidation, tarnishing, fading, or appearance changes caused by ordinary use are not automatically considered manufacturing defects.

25. Jewelry Care

Customers are responsible for following reasonable jewelry-care instructions.

For removable pieces, we generally recommend:

  • Putting jewelry on after cosmetics, lotions, fragrances, and styling products;

  • Removing jewelry before activities likely to cause damage where practical;

  • Wiping jewelry after wear where appropriate; and

  • Storing jewelry in a clean, dry location.

Product-specific care instructions may also apply.

Failure to follow reasonable care instructions may affect warranty eligibility.

26. Handmade Characteristics

Many Ellara pieces are assembled, customized, engraved, finished, or handmade in our Edmonton studio.

Minor variations are normal.

These may include small variations in:

  • Placement

  • Dimensions

  • Alignment

  • Finish

  • Texture

  • Engraving

  • Stone appearance

  • Stone colour

  • Chain position

  • Charm placement

These variations are part of the individually made nature of our products and are not necessarily manufacturing defects.

27. Colours, Stones & Screens

Natural, synthetic, lab-created, glass, enamel, or decorative components may display variation depending on the item.

We make reasonable efforts to photograph colours accurately.

However, screens, lighting, photography, manufacturing batches, and individual components may cause slight colour differences.

Minor colour variation alone is not considered a defect.

PRODUCT IMAGES & INFORMATION

28. Product Photography

Product photographs, CAD renderings, lifestyle photography, and digital customization previews are intended to help illustrate our products.

Close-up photography may make jewelry appear larger than its actual physical size.

Customers should review written measurements in addition to photographs.

29. Measurements

Product measurements are approximate unless expressly stated otherwise.

Small tolerances may occur during manufacturing and handmade assembly.

ORDER CHANGES & FRAUD PREVENTION

30. Order Changes

If you notice an error after placing an order, contact Ellara as soon as possible.

We may be able to accommodate changes before production begins but cannot guarantee that changes will be possible.

31. Custom Order Cancellations

Custom, engraved, personalized, DesignMe, and made-to-order pieces may enter production shortly after purchase.

Once production has begun, cancellation may no longer be possible.

Production may include:

  • Chain cutting

  • Sizing

  • Assembly

  • Engraving

  • Personalization

  • Finishing

  • DesignMe assembly

  • Packaging or fulfillment

This section does not restrict cancellation rights provided by applicable legislation.

32. Shipping Address Changes After Purchase

For fraud prevention and chargeback protection, Ellara generally does not manually change the shipping address on a completed online order.

If you entered the wrong shipping address and the order has not yet shipped, please contact us immediately.

Where an address change is required, Ellara may cancel and refund the original eligible order and require the customer to place a new order using the correct shipping address.

This helps ensure that the billing, payment, order, and shipping records remain consistent.

Custom or personalized work that has already entered production may be subject to the cancellation provisions of these Terms and applicable law.

Once an order has shipped, the address generally cannot be changed by Ellara.

SHIPPING

33. Current Shipping Area

Ellara currently ships online orders within Canada.

Shipping availability may change in the future.

We may introduce shipping to additional markets, including the United States, United Kingdom, or other locations, at our discretion.

The destinations and shipping rates displayed at checkout at the time of purchase will govern the order.

34. Processing Times

Our typical processing target is approximately 1–3 business days, unless otherwise stated.

Personalized, engraved, made-to-order, DesignMe, special-order, or high-volume orders may require additional processing time.

Processing time is separate from carrier transit time.

35. Canada-Wide Shipping

Ellara may offer free standard shipping within Canada where displayed on our website.

Shipping programs, minimums, methods, or rates may change.

The shipping options shown during checkout apply to the order being placed.

36. Signature Required for Orders of $150 or More

Orders with a value of $150 CAD or more require signature confirmation upon delivery.

This requirement is intended to provide additional protection for higher-value shipments.

Customers are responsible for ensuring that someone is available to receive or collect signature-required shipments according to the carrier's procedures.

Ellara may also require a signature for other orders where reasonably appropriate due to value, destination, fraud prevention, or carrier requirements.

37. PO Box Shipping

Shipping to a PO box may require a different or more expensive carrier service.

Where our standard or free shipping method cannot be used for a PO box, the customer may be required to select and pay for the applicable express or eligible PO box shipping option displayed during checkout.

Ellara cannot waive additional carrier costs created by delivery to a PO box.

If no eligible PO box shipping service is available for a particular shipment, we may contact the customer or cancel and refund the unfulfilled order where appropriate.

38. Delivery Estimates

Delivery dates provided by carriers are generally estimates unless the carrier expressly guarantees the service.

Delivery may be affected by:

  • Weather

  • Carrier delays

  • Labour disruptions

  • Transportation interruptions

  • High-volume periods

  • Incorrect addresses

  • Remote destinations

  • Government actions

  • Circumstances outside our reasonable control

Nothing in this section limits statutory delivery or cancellation rights.

39. Delivery Confirmation, Loss & Theft

Customers should contact Ellara promptly if a shipment appears to be lost, damaged, or incorrectly delivered.

Where a carrier confirms that a shipment was delivered to the address provided with the order, Ellara may require an investigation with the carrier before determining whether any additional remedy is available.

Customers are responsible for providing a secure and accurate delivery location.

Nothing in this section limits rights available under applicable consumer protection law.

40. Future International Shipping

Ellara currently ships within Canada.

If international shipping becomes available, anticipated international shipping rates may begin around $25 CAD, but international rates are subject to change based on destination, carrier, parcel size, service level, insurance requirements, and other shipping costs.

The actual rate shown during checkout at the time of purchase will apply.

International customers may be responsible for duties, import taxes, VAT, brokerage fees, customs charges, and other fees imposed by their jurisdiction unless Ellara specifically states that those costs have been prepaid.

APPOINTMENTS & DEPOSITS

41. Appointment Deposits

Certain in-studio appointments require a $30 booking deposit.

The deposit is intended primarily to reserve appointment time and reduce no-shows.

When the customer purchases jewelry during the appointment, the deposit is applied toward the purchase.

42. No-Purchase Appointments

Our priority is for customers to choose jewelry they genuinely love.

If you attend your appointment and decide not to purchase anything, your deposit will be refunded.

There is no obligation to purchase jewelry simply because you booked an appointment.

43. Appointment Cancellation

We ask customers to provide at least 24 hours' notice when cancelling an appointment.

If adequate notice is provided, the deposit may be refunded in accordance with our booking policy.

Appointments cancelled with less than 24 hours' notice, or appointments that are missed without notice, may result in the deposit being retained to help cover the reserved appointment time.

44. Rescheduling

We understand that plans change.

Customers may reschedule an appointment without losing the deposit where reasonable notice is provided.

We ask for approximately 12–24 hours' notice whenever possible.

The deposit can then be transferred to the rescheduled appointment.

Repeated late cancellations, repeated rescheduling with inadequate notice, or no-shows may result in the deposit being forfeited or a new deposit being required before another appointment is booked.

RETURNS & REFUNDS

45. Return & Refund Policy

Returns and refunds are governed by our separate Return & Refund Policy.

The following are generally final sale:

  • Permanent jewelry

  • Custom-fitted jewelry

  • Custom-sized jewelry

  • Made-to-order jewelry

  • DesignMe jewelry

  • Personalized jewelry

  • Engraved jewelry

  • Worn jewelry

  • Items specifically marked Final Sale

Damaged, defective, or incorrect items are handled under our Return & Refund Policy and applicable consumer law.

WARRANTY

46. Ellara Jewelry Warranty

Ellara maintains a separate detailed Warranty Policy, which governs warranty claims.

Our permanent jewelry currently includes a 90-day warranty, subject to the complete Warranty Policy.

Where permanent jewelry breaks specifically at the original weld point, Ellara may provide a complimentary re-weld in accordance with the Warranty Policy.

For qualifying permanent jewelry that is lost within the first 30 days, replacement coverage may be available in accordance with our Warranty Policy and its applicable terms and exclusions.

Warranty coverage does not mean that jewelry is guaranteed against every form of:

  • Loss

  • Damage

  • Snagging

  • Pulling

  • Accidental breakage

  • Normal wear

  • Misuse

  • Modification

  • Improper care

After the applicable warranty period, repairs, replacements, re-welding, or other services may be available for a fee.

The full Warranty Policy governs if there is any difference between this summary and the detailed warranty terms.

GIFT CARDS

47. Physical & Electronic Gift Cards

Ellara offers both physical gift cards and electronic gift cards (e-gift cards) where available.

Gift cards may be used toward eligible Ellara products and services according to the terms applicable at the time of redemption.

Gift cards:

  • Cannot generally be redeemed for cash except where required by law;

  • Should be treated like cash;

  • May not be replaced if lost, stolen, deleted, or used without authorization unless Ellara is legally required or reasonably able to do so; and

  • May be subject to reasonable technical or security verification.

Applicable expiry and fee rules will comply with Canadian and Alberta law.

PROMOTIONS & DISCOUNTS

48. Promotions

Promotional offers may have additional conditions displayed when the promotion is offered.

Unless otherwise stated:

  • Promotions cannot be exchanged for cash.

  • Promotions may not be combinable.

  • Promotional pricing applies only during the advertised period.

  • Discounts may not be applied retroactively.

  • Product or service exclusions may apply.

Ellara may correct promotions affected by genuine technical, inventory, or pricing errors.

  • Circumstances outside our reasonable control

55. Customer Reviews & Submissions

Customers may submit reviews, photographs, feedback, or other content where such functionality is available.

Customers must have the right to submit any content they provide.

Content must not:

  • Be fraudulent or deliberately misleading;

  • Infringe another person's rights;

  • Contain unlawful material; or

  • Contain malicious code.

Ellara may moderate or remove submissions where reasonably appropriate and legally permitted.

We will not remove a customer review merely because it expresses a negative opinion.

By ordering or contacting Ellara electronically, you agree that transaction-related communications may be delivered electronically.

These may include:

  • Order confirmations

  • Shipping notifications

  • Appointment information

  • Service notices

Jewelry should be worn appropriately for the circumstances.

Customers are responsible for determining whether wearing a particular piece is suitable for their:

  • Activities

  • Employment

  • Sports

  • Lifestyle

  • Environment

Jewelry is not safety equipment.

Extra caution should be used around machinery, equipment, children, sports, or environments where jewelry could become caught or snagged.

58. Limitation of Liability

  • Failure to follow care instructions

  • Customer alterations

  • Infringement of another person's rights.

Customers are not responsible for Ellara's own unlawful conduct or obligations that cannot legally be transferred to consumers.

CHARGEBACKS & FRAUD

60. Payment Disputes

If you believe there is an issue with an order, we encourage you to contact Ellara so that we have an opportunity to investigate and resolve the matter.

Submitting a chargeback does not automatically make an otherwise valid final-sale product eligible for a refund.

When responding to a payment dispute, Ellara may provide relevant transaction information to the applicable payment processor, bank, or card issuer, including:

  • Order records

  • Customer selections

  • Measurements

  • Personalization information

Ellara operates from Alberta, Canada and intends to comply with applicable consumer protection requirements.

Nothing contained in these Terms, our final-sale provisions, Return & Refund Policy, Warranty Policy, Shipping Policy, or any other Ellara policy is intended to waive, restrict, release, or exclude a customer's rights where applicable law does not permit those rights to be waived.

Where applicable consumer protection legislation provides rights that conflict with a provision of these Terms, the applicable legislation will govern.

63. Online Purchases

For transactions governed by Alberta's Internet Sales Contract Regulation or other applicable consumer protection legislation, Ellara will provide required information regarding the transaction, including applicable product information, pricing, additional costs, payment arrangements, delivery information, and return, cancellation, exchange, or refund policies.

Any statutory cancellation rights available under applicable legislation remain unaffected by these Terms.

Nothing in these Terms requires a consumer to waive a right to access the courts or other remedies available under applicable law.

65. Resolving Concerns

If a concern arises regarding an Ellara product or service, we encourage customers to contact us first so that we can review the issue and attempt to resolve it fairly.

Nothing in this section prevents either party from exercising rights available under applicable law.

66. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

67. No Waiver

If Ellara does not immediately enforce a provision of these Terms, this does not necessarily mean that we have waived the right to enforce that provision in the future.

68. Entire Agreement

These Terms, together with applicable policies and product-specific conditions incorporated by reference, form the agreement governing applicable retail purchases and use of Ellara's website and services.

Wholesale and B2B transactions are governed separately.

  • Products

  • Services

  • Business practices

  • Technology

  • Shipping

  • Policies

  • Applicable laws or regulations

The current version will be posted on our website with an updated revision date.

Changes will not retroactively remove rights that have already accrued under applicable law.
